What is business legal advice?

It is legal support for your company where most lawsuits and penalties come from: employment contracts, dismissals, disciplinary procedures, the incorporation and amendments of your company, and contracts with clients, suppliers, partners and the government.

It is preventive: we review and correct before there is a problem. And because the lawyer works with the accountant, every decision is also checked for its tax effect.

What if a proceeding has already started?

In tax matters we represent you directly: inquiries, official assessments, appeals and lawsuits before the administrative courts. In other proceedings we review the case and support you with strategy and documentation.

What's included?

The employment, commercial and tax side of your company, with payroll and accounting on the same team.

Employment

To prevent lawsuits and penalties from the Ministry of Labor.

  • Review of contracts and internal work rules
  • Dismissals: cost and procedure before deciding
  • Compliance with the labor reform, Law 2466 of 2025

Corporate and commercial

So your company and your deals are properly set up.

  • S.A.S. incorporation, amendments, minutes and liquidation
  • Service, supply, NDA and shareholder agreements
  • Trademark registration with the SIC

Tax and government

Where legal and tax matters meet.

  • Tax litigation against the DIAN and municipal tax offices, up to the administrative courts
  • Government contracts, observations and bonds
  • Tax planning for your decisions

Our legal services

From setting up your company to defending it in court, with the tax view of an accountant in every decision.

Company formation

We set up your S.A.S. around your business vision: bylaws, Chamber of Commerce registration, RUT tax ID and the tax regime that fits, with accounting ready from the first month.

Corporate law

Shareholder meetings and minutes, bylaw amendments, new partners, reorganizations and liquidation, so your company stays in order as it grows.

Commercial contracts

Service, supply, distribution, confidentiality, lease and shareholder agreements, designed with their tax effects in mind.

Contracting with the State

Tenders on SECOP II, observations, bonds and the management of government contracts, from the bid to the final settlement.

Tax litigation

We defend your company against the DIAN and municipal tax offices: responses to inquiries, official assessments and penalties, administrative appeals and lawsuits before the administrative courts.

Corporate and contract litigation

Disputes between shareholders and breaches of contract, with private companies or public entities, handled by the team that knows your business.

Employment law

Employment contracts, internal work rules, disciplinary procedures and dismissals, updated to the 2025 labor reform.

Trademark registration

Before you invest in a brand in Colombia, make sure it is yours. We run the availability search, file the application with the Superintendence of Industry and Commerce (SIC) and follow it until the registration is granted.

Tax planning

The tax impact of your decisions before you make them, and an orderly relationship with the tax authority from day one.

How much does dismissal without just cause cost in 2026?

It depends on the type of contract and, for indefinite-term contracts, on salary and seniority (art. 64 of the Colombian Labor Code). The severance is added to the settlement of benefits.

ContractFirst yearEach additional year
Indefinite term, salary under 10 minimum wages (COP 17,509,050)30 days20 days, and pro rata
Indefinite term, salary of 10 minimum wages or more20 days15 days, and pro rata
Fixed termThe wages for the time remaining in the agreed term
Specific work or taskThe wages until the end of the work, minimum 15 days

Does not include the late-payment penalty for unpaid benefits (art. 65 of the Labor Code) or damages claimed before a judge. This is an estimate: it does not replace a review of your case.

Dismissal without just cause by type of contract.

Art. 64 of the Labor Code.

How we apply it in practice

Two typical situations, with example figures, that are best solved before they become a problem.

Dismissal without just cause, indefinite-term contract

Salary of COP 2,500,000 and 2 years and 6 months of seniority: 30 days + 20 days × 1.5 years = 60 days at COP 83,333. It is calculated before talking to the employee, to negotiate with the exact figure.

COP 5,000,000

From individual to S.A.S.

To hire staff, bid on tenders and apply for credit without exposing personal assets: liability limited to capital (Law 1258 of 2008), bylaws, Chamber of Commerce, RUT tax ID and the tax regime that suits you best, with the accounting ready from the first month.

S.A.S.

Questions about legal advice

How much must my company pay for dismissal without just cause in 2026?

It depends on the contract: for an indefinite-term contract, 30 days for the first year and 20 for each additional year if the salary is under 10 minimum wages. Use the calculator on this page for your case.

What is employment risk protection?

Reviewing contracts, internal work rules and disciplinary procedures so they comply with current law and don't turn into lawsuits.

Can you incorporate my company from scratch?

Yes: bylaws, Chamber of Commerce registration, RUT tax ID and the most suitable tax regime, with the accounting ready from the first month.

What types of contracts do you draft?

Employment, services, supply, confidentiality, shareholder, distribution and lease agreements, and contracts with the government.

Do you take cases that have already started?

In tax matters we handle them directly. In other proceedings we review the case and support you with the strategy.

Does the dismissal severance include the transport allowance?

No. It is calculated on the salary, without the transport allowance.

In what language are the contracts?

Documents filed with Colombian authorities must be in Spanish. Camila Cubillos, a partner of the firm, explains every clause to you in English.
